Terms of Service

These Terms of Service ("Terms") govern your use of pearl-asheville.com (the "Site") and any purchase you make through it. The Site is operated by MD LDA LLC, a limited liability company registered in the State of Wyoming, United States, trading as Pearl Asheville ("we", "us", "our").
By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you meet that requirement and that the payment method you use is yours or that you are authorized to use it.
2. Products and Descriptions
We describe our products as accurately as we can. Photographs are representative; colors and textures can look different depending on your screen. Because our products are made in small batches, minor variation between individual pieces is normal and is not a defect.
We may change, limit or discontinue any product at any time, and we may limit the quantity of any item that a single customer may buy.
3. Prices and Promotions
All prices are shown in U.S. dollars (USD) and exclude sales tax, which is calculated at checkout. Prices may change at any time, but a change never affects an order that has already been accepted.
Where a discount, sale price or crossed-out reference price is shown, it applies only for the period and on the conditions stated with that offer. Promotions cannot be combined unless we say so, and cannot be applied to an order after it has been placed.
We work to keep the Site free of errors, but mistakes happen. If an item is listed at an obviously incorrect price, we may cancel the order and refund you in full, even after the confirmation email has been sent. We will always contact you first.
4. Orders and Acceptance
Your order is an offer to buy. The automatic confirmation email acknowledges that we received it; a contract of sale is formed when we ship the order. We may decline or cancel an order, in whole or in part, if the item is unavailable, if we suspect fraud or unauthorized use of a payment method, or if there was an error in the listing. If we cancel, we refund you in full.
5. Payment
Payment is taken at checkout through our payment processors, using the methods shown there. We do not receive or store your full card number; card data is handled directly by our processors under their own security standards. You are responsible for any fee your bank or card issuer charges you, including foreign transaction fees.
6. Shipping and Delivery
Shipping, delivery timeframes and your right to cancel a delayed order are set out in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you on delivery to the address you gave us.
7. Returns and Refunds
Returns, exchanges and refunds are governed by our Refund & Return Policy, which forms part of these Terms.
8. Acceptable Use
You agree not to use the Site to break the law, to infringe anyone's rights, to send spam or malicious code, to scrape or copy the Site at scale, to interfere with its security or availability, or to buy products for resale without our written permission. We may suspend or refuse service to anyone who does.
9. Intellectual Property
The Site and its content — text, photographs, graphics, designs, logos and the Pearl Asheville name — belong to us or to our licensors and are protected by U.S. and international intellectual property law. You may view and share content for personal, non-commercial purposes. Any other use, including reproduction or commercial use, requires our written permission.
10. Content You Submit
If you send us a review, photograph, comment or other content, you keep ownership of it and grant us a non-exclusive, royalty-free, worldwide license to use, display and reproduce it in connection with our business. You confirm that the content is yours to give and that it does not infringe anyone's rights. We may remove submitted content at our discretion.
11. Third-Party Links
The Site may link to websites we do not control. We are not responsible for their content, products or privacy practices, and a link is not an endorsement.
12. Disclaimer of Warranties
Except where the law provides otherwise, and except for any express warranty we give in writing, the Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free.
Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
13. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or connected with your use of the Site or any product bought through it, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.
Some states do not allow the limitation or exclusion of certain damages, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
You agree to indemnify and hold harmless MD LDA LLC and its officers, members and agents from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.
15. Privacy
How we handle personal information is described in our Privacy Policy and, for California residents, in our California Privacy Notice. You can manage your advertising and data-sharing preferences at any time through Your Privacy Choices.
16. Governing Law
These Terms and any dispute arising out of them are governed by the laws of the State of Wyoming and the applicable federal law of the United States, without regard to conflict of law principles. The courts located in the State of Wyoming have jurisdiction, and you and we each consent to that jurisdiction. This does not deprive you of the protection of any mandatory consumer law of your state of residence.
17. Severability and Waiver
If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
18. Changes to These Terms
We may update these Terms. The version published on this page when you place an order is the version that applies to that order. The date at the top shows when this page was last changed.
